The National Library of Belarus has prepared and sent to the Library Assembly of Eurasia the offer on modification and additions in the model Library code for the CIS member-states.
It is offered to make changes and additions to the model Library code for the CIS member-states concerning creation of electronic copies of documents and their availability to users (according to the Law of the Republic of Belarus approved on May, 17th, 2011 262-з, accepted by the House of Representatives on April, 27th, 2011 and approved by the Council of the Republic on April, 28th, 2011).
On May, 16th, 2012, there took place the session of the Permanent commission of the Inter Parliamentary Assembly of the CIS Members on culture, information, tourism and sports on which the given offers have been approved.
The commission has decided:
- To agree with the offer of the Library Assembly of Eurasia and to add clause 51 “General availability of the national library” of chapter 16 of the model Library code for the CIS member-states with paragraphs of the following contents:
- the authorization to create single copies, including those in electronic form, copies of works legally put into civil circulation under the condition that any profit will be made without the permission of the author or other legal owner and without payment of fee, but with the obligatory indication of a name of the author whose work is used, and source of loan:
- with a view of safety and availability to users:
- dilapidated, worn out, spoiled, defective copies of works;
- single and (or) rare copies of works, manuscripts that, being delivered to users, can be lost, damaged or destructed;
- copies of works recorded on machine-readable media in the absence of necessary equipment for their use;
- copies of works having exclusively scientific and educational value;
- with a view of restoration, replacement of lost or spoiled copies of works, and also for provision of copies of works to other public libraries which have lost them for any reasons from their stocks.
At the same time copies of works in electronic form can be delivered temporary (including by way of mutual use of library resources) only in a library under the condition that any other copies of works won’t be made;
- with a view of safety and availability to users:
- the permission to create the single copy and to give copies, including those in electronic form, of separate articles and small-sized works legally published in collections, newspapers and other periodical printed editions, short fragments from other legally published written products (with illustrations or without illustrations) concerning citizens for scientific and educational purposes under the condition that any profit will be made without the permission of the author or other legal owner and without payment of fee, but with the obligatory indication of a name of the author whose work is used, and source of loan.

- To solicit the Council of the Inter Parliamentary Assembly of the CIS Members for submitting the question “About modification and additions to the model Library code for the CIS member-states” for consideration at the plenary session of the Inter Parliamentary Assembly of the CIS Members.
- To charge chairman of the commission, member of the Committee of the Council of the Federation of the Federal Assembly of the Russian Federation for constitutional legislation, legal and judicial questions and civil society development E.G. Tarlo with speaking at the plenary session of the Inter Parliamentary Assembly of the CIS Members on the given question.
